These Terms and Conditions (“Terms”) govern your use of the GenK mobile application (“the App”), provided by NOERDEN, 31 Cours Albert 1er, 75008 Paris, France (“we”, “us”, or “our”).

 

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

 

 

 

1. Eligibility

GenK is intended for users aged 13 years or older.

By using the App, you confirm that:

  • You are at least 13 years old

  • You have the legal capacity to accept these Terms

If you are under the age required by your jurisdiction, you must use the App under parental supervision.

2. Description of the Service

GenK provides educational micro-learning content, quizzes, and progress-tracking features designed to support general knowledge learning.

Features of the App may include:

  • Personalized learning content

  • AI-generated quizzes

  • Progress tracking and streaks

  • Notifications and reminders

  • Optional social or competitive features

We reserve the right to modify, update, or discontinue features at any time.

3. Accounts

You may use the App anonymously.

You may optionally create an account using Apple Sign-In or Google Sign-In.

You are responsible for maintaining the confidentiality of your account credentials and for all activities associated with your account.

We may suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Certain features of GenK require a paid subscription.

All purchases are processed exclusively through Apple’s in-app purchase system.

Subscriptions:

  • Automatically renew unless cancelled at least 24 hours before renewal

  • Can be managed in your Apple ID account settings

  • Are subject to Apple’s billing terms and policies

We do not control Apple’s payment processing and are not responsible for billing issues handled by Apple.

5. Artificial Intelligence Content

Some learning content and quizzes may be generated using artificial intelligence technologies.

While we strive for accuracy, AI-generated content:

  • May contain inaccuracies or simplifications

  • Should be considered educational support, not authoritative reference material

GenK is not liable for decisions made based on AI-generated content.

6. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes

  • Attempt to reverse engineer, copy, or exploit the App

  • Interfere with the App’s functionality or servers

  • Use automated systems to access the App

  • Upload harmful or malicious content

Violation of these rules may result in account suspension or termination.

 

7. Intellectual Property

All content in the App, including:

  • Text

  • Graphics

  • Design

  • Software

  • Logos

  • Learning content

is owned by NOERDEN or its licensors and protected by intellectual property laws.

You may use the App for personal, non-commercial purposes only.

You may not copy, distribute, or commercially exploit any part of the App without written permission.

8. Availability of the Service

We strive to keep the App available and functioning properly, but we do not guarantee uninterrupted access.

We are not liable for:

  • Temporary outages

  • Technical failures

  • Maintenance interruptions

  • Network or device issues beyond our control

9. Limitation of Liability

To the fullest extent permitted by law:

GenK is provided “as is” and “as available”.

We are not liable for:

  • Indirect or consequential damages

  • Loss of data or progress

  • Decisions made based on learning content

  • Service interruptions

Nothing in these Terms excludes liability where it cannot be excluded by law.

10. Termination

You may stop using the App at any time.

You may delete your account within the App.

We reserve the right to suspend or terminate access if you violate these Terms or misuse the service.

11. Changes to the Terms

We may update these Terms periodically.

If significant changes occur, we may notify users within the App.

Continued use of the App after updates constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of France, without regard to conflict-of-law principles.

Where applicable, consumers may also benefit from mandatory protections of their country of residence.
